Telecom Italia acknowledges the rejection by the Lazio Regional Administrative Court of its appeal to cancel the ruling with which the Autorità Garante per la Concorrenza e il Mercato (Italian Competition and Market Authority) in May 2013 imposed a monetary sanction for more than 103 million euros for alleged abuses of dominant position in the access service market and intends to reaffirm that its behavior was correct with regards to equality of access to the network for alternative Operators.
The Open Access model continues to be considered a best practice at European level with regards to equality of access, whose validity has been recognised both by the European Union and by the BEREC (the European body which supervises the regulatory framework).
Telecom Italia does not agree with the decision of the Lazio Regional Administrative Court, and believes that the administrative judge of first instance did not adequately consider the numerous and detailed reasons presented in the Company’s appeal.
Telecom Italia intends, therefore, to continue its action to obtain recognition of the absolute legality of its conduct towards its competitors, and will shortly appeal to the Council of State against the TAR's decision.
